Terms and agreement

General terms and conditions

These general terms and conditions are applicable to all offers and agreements with Vase The World. Any purchasing terms used by the customer are excluded and are expressly not applicable. Vase The World reserves the right to amend these terms and conditions at all times. In that case Vase The World shall inform the customer of any changes, whereupon the amended terms shall apply to all new offers and agreements.

Offers are made without commitment and are valid for 30 days following the date of issue. Contracts come into existence once the customer has accepted an offer from Vase The World, and Vase The World has confirmed its agreement by email.

The products on offer comprise a description and/or illustration which is as true and accurate as possible, and they satisfy the normal requirements which apply in the normal course of business.

The prices stated for the products on offer are in Euros, and exclude BTW/VAT. Delivery costs depend on the size of the order; they will be notified prior to or at the time of entering into agreement, and they are payable by the customer. The same applies to any import duties incurred.

If it is stated that the products on offer are in stock, the delivery period in the Netherlands is 1-3 working days after confirmation of the order, and 5-7 working days in other EU countries, unless there is a situation of force majeure, which shall be understood to include: extreme weather conditions and strikes by suppliers.

Payment is to be made in accordance with the manner described on the website. In the case of delayed payment the customer is liable, without further notice of breach of contract, to pay late payment interest of 1.5% per month, together with compensation for all out of court collection costs ; furthermore any products already delivered remain the property of Vase The World until the moment that the customer has correctly complied with all payment obligations arising under the contract entered into with Vase The World. In that case the customer may not pledge the products, sell them, dispose of them, or in any other sense assign any rights to them, and the customer shall ensure that the products involved are separately identifiable. The above is without prejudice to the entitlement of Vase The World to dissolve the contract, to demand return of the products, and to make a claim for damages, including transport costs, with immediate effect, and without further notification of breach of contract.

The customer shall inspect products that are delivered at the time of delivery, for damage in transit, and shall report the number of packages and defects immediately on the delivery note. Furthermore the customer shall inspect the products delivered within 24 hours of delivery in respect of quantity and quality. However each product is handmade, and therefore has its own unique look, whereby slight differences in colour and gloss between them are inevitable, so this cannot be viewed as a defect. Any defects must be reported by telephone and then by email to info@vasetheworld.nl, with explanations and documented with photographs, within no more than 48 hours of delivery. In the absence of inspection and/or a claim being made on time, within the meaning of this article, the products will be deemed to have been delivered in good condition and Vase The World will not be bound to send replacement products or offer any other form of compensation.

If a complaint is recognised as being the responsibility of Vase The World a replacement product will be supplied along with the next delivery, provided that the defective products are returned in their original packaging. Vase The World is not bound to make any other compensation for the defect, other than as stated in the previous sentence. In case this is not supported by the law, the responsibility of Vase The World is at all times limited to a maximum amount equal to the invoice value of the products to which the defect relates

In the event of resale, customers will adhere to the price agreements entered into with Vase The World.

Dutch law is applicable to all legal matters involving Vase The World. Any disputes which cannot be resolved together will be subject to the exclusive jurisdiction of the competent court in Amsterdam.
